Mr O’Toole said that Mr Cormican “admitted using this language” at a meeting the following day, was dismissed by a company director and did not appeal his sacking. In his decision, adjudicating officer Kevin Baneham wrote that the most significant conflict of evidence in the case was the alleged use of a racial slur.
