A tug of war ensued between defence Advocate Malesela Teffo and a production house contracted by streaming giant Netflix over potential harassment and intimidation of witnesses as a result of a documentary that was flighted on the streaming service about the murder of former Bafana Bafana captain Senzo Meyiwa.
Ten Ten Productions was granted access to film the proceedings when the trial began in April. However, Teffo, who is the defence lawyer for four of the five men accused of gunning down the former Orlando Pirates goalkeeper, accused the media company of pursuing profit rather than informing the public about court processes.They are not a media company.
Winks also debunked the proposition that Ten Ten is not a media company, citing that should a gagging order be granted, it would be a severe violation of its constitutional rights. Judge Tshifhiwa Maumela asked Winks whether there was a possibility of airing more episodes while the trial was under way, to which he responded: “There is no legal basis prohibiting my client from doing so; however, it should not hinder or negatively affect the administration of justice.”
