Handing down his judgement today, Magistrate James Lawton said the incident could have been easily avoided.

The employee was injured in 2022 when a cable he was winding with a machine became jammed, forcing a cable rack carrying hundreds of kilograms of equipment to fall onto him.Metal Manufacturers Proprietary Limited has been fined $375,000, while the site manager was also fined $7,500 in the ACT Industrial Court.

CCTV captured the cable rack falling on top of his head, pushing him onto the frame of the winding machine. "In fact, the step which ought to have been taken was known to the defendants and was part of the standard installation procedure for racks of this kind."The parties will also have to pay $35,000 and $10,000 respectively for WorkSafe ACT's costs.
