Parliament is seeking legal advice on the R10 million gratuity for ousted Public Protector.

Parliament has confirmed that it is considering taking legal advice from senior counsel regarding the payment of R10 million gratuity to ousted Public Protector Advocate Busisiwe Mkhwebane.Her term was due to end on October 14.

Parliament’s Spokesperson, Moloto Mothapo says another complication is that the acting Public Protector Advocate Kholeka Gcaleka is conflicted because she has been recommended for the position of Public Protector. Mothapo says, “We are currently evaluating whether it is necessary to consult with an external senior counsel for advice on this matter. The advice will help us determine whether the resolution that the National Assembly has taken with regard to the gratuity of the Public Protector includes provisions for the gratuity of both office termination and vacation, as these terms are being used without clear definitions.
