Mariano De Marinis was cleared after an Ontario Superior Court judge ruled the complainant was an unreliable, untrustworthy witness.

After flirtatious texts between the woman and De Marinis in 2015, the bar manager was accused of sexually assaulting a drunk trainee in the washroom, but the judge cleared him after analyzing the evidence. The complainant also testified she felt coerced by De Marinis to drink on the job, but the judge ruled otherwise.

Another glaring inconsistency was that the woman who wanted to kill herself testified that she left a suicide note citing De Marinis as the reason. The Court of Appeal for Ontario ruled the trial judge made a serious legal error by accusing De Marinis of “tailoring” his testimony to evidence he knew the Crown would present.
