Attorneys for the business owner said he would appeal the decision.

Carlos Pena visits his business NoHo Printing and Graphics on Wednesday, July 19, 2023 which was destroyed last year after a federal fugitive barricaded himself in the North Hollywood business. Pena said rounds of tear gas destroyed the walls and ceiling and all his equipment leaving him working out of his garage after 32 years. He said he has lost over 80 percent of his business and has filed a federal lawsuit to recover the damages.

In his ruling, Walter found that governments are allowed to seize property when they’re doing so as part of criminal investigations, as opposed to when they take property using their civil powers under eminent domain.“We’ll keep going as long as we have to, even if that means we have to petition the Supreme Court for a review,” said Jeffrey Redfern, one of Pena’s attorneys who works for the Institute of Justice, a national non-profit law firm.

After the officers entered the crawl space themselves, using a camera for tight spots they couldn’t access, they realized the man was not there.
