In the aftermath of Indiana’s near-total abortion ban, some businesses have announced plans to expand outside of the state for fear of the law’s impact on workforce retention.

Eli Lilly and Cummins have publicly stated their opposition to the new law. But, before the law was signed, hundreds of local Indiana businesses singed a “Don’t Ban Equality” letter drafted by the American Civil Liberties Union of Indiana.“Restricting access to comprehensive reproductive care, including abortion, threatens the health, independence and economic stability of our employees and customers. Simply put, it goes against our values, and is bad for business.

On Saturday morning, a few hours after Holcomb signed the law, Eli Lilly representatives issued a statement objecting to the new law stating the company “will be forced to plan for more employment growth outside our home state.” “Cummins believes that women should have the right to make reproductive healthcare decisions as a matter of gender equity, ensuring that women have the same opportunity as others to participate in the workforce and that our workforce is diverse. This law is contrary to this goal and we oppose it,” Mills said.

But, Browning said, the more he considered the announcements it became clear that it is possible for the companies to take a stance because neither work directly with consumers.Indiana has a Republican supermajority, Browning said, and the Republican Party has been known as the party to focus on business interests. If companies like Eli Lilly and Cummins applied more public pressure against the bill, Browning said it might have had an impact.

For the state, Browning said the company announcements “could be potentially devastating,” depending on how the companies move forward.
