A Cape security company that challenged the Western Cape Government on a questionable tender decision has lost the first round of its legal battle.The Western Cape High Court dismissed Part A of an application the company submitted to interdict the enterprise awarded the tender. Seal Security lost a bid to an R282 million security contract, which was awarded to Durban businessman Roy Moodley and his company, Royal Security. The business has been associated with several state capture scandals.

In response to losing the bid, Seal Security made allegations of severe irregularities in the tender process and applied for an interdict to prevent the WCG from appointing Royal Security. This motion has however been dismissed.In the second part of its legal challenge, Seal Security is requesting that the court set aside the tender decision to appoint Royal Security as the successful bidder. This is still being decided on.

Tertuis Simmers, a member of the executive council of the Department of Infrastructure, says the department can’t comment on the ruling as the matter is still ongoing. ‘Due to the matter not being finalised and Part B still to be heard before the court, we cannot give comment on the sub-judice matter.’
