On Thursday, the party argued in the Electoral Court sitting at the Johannesburg High Court that the President had abused his power and public funds to garner votes for the ANC.
Counsel on behalf of the president, in his capacity as head of state, submitted that the former opposition party did not properly interpret the provisions of the legislation on which the party has relied. Advocate Ngwako Maenetje argued that the Act only makes provision for an abuse of power but not an incidental benefit for the ANC.
“If the president used the occasion for a proper or authorised purpose, but it could incidentally also benefit the ANC, one can’t say there is a prohibition,” argued Maenetje. He added that while the occasion would have come across as though it was for the ANC’s gain, that’s not what Ramaphosa had set out to do.
