The Housing Industry Association has thrown support behind the planned superannuation guarantee amnesty | MsEmmaK

Leading home builders have thrown support behind a planned amnesty for underpayment of superannuation, pointing to complexities and red tape in the system which could cause some businesses to make mistakes.

The building sector faces complicated rules around the payment of super, the Housing Industry Association says.The HIA's submission to a Senate committee consultation on super amnesty laws, which closed on Thursday, said the government should pass the bill and increase its scope so that it runs for 12 months from September 2019.

The HIA pointed to complex laws and "red tape" in the building sector which means businesses must undertake detailed calculations to work out whether staff are employees or contractors and whether they must pay them superannuation.The building group also argued the lack of flexibility around penalties for unpaid super deters businesses from coming forward.
