Company lawyers slam Competition Bureau’s ‘hyperbolic’ arguments as Rogers-Shaw merger hearing wraps up

Counsel for Rogers, Shaw and Vidéotron argued series of transactions will benefit consumers, a starkly different picture than that painted by the competition watchdog.

Lawyers for Rogers and Shaw insist the companies’ merger will lead to a renewed fight for home internet customers in Western Canada, while a side deal with Vidéotron will see the “maverick” wireless operator make a bold push outside its home province, another consumer win.

Earlier this year, Rogers struck a side deal to sell Freedom Mobile, Shaw’s wireless business that operates in Ontario, British Columbia and Alberta, to Vidéotron for $2.85 billion. “The efforts to deride Vidéotron’s ability to compete successfully in the wireless business in Western Canada are entirely without merit,” said Kent Thomson, a lawyer for Shaw.

John Rook, a lawyer for Vidéotron said the company has long wanted to acquire Freedom Mobile and put forth a detailed business plan for success if it closes the deal for the carrier and its 1.7 million cellphone customers. “Rogers is a substantially larger and better resourced company than Shaw,” Thomson said, adding, If this transaction is allowed to proceed, Rogers will bring to bear its enormous experience, expertise, scale and resources to compete aggressively and successfully against Telus.”

He said in October that if he were to approve the transfer of licences to use wireless spectrum licences to Vidéotron, he would expect the company to make a long-term commitment and offer lower prices.
