The realty company that owned a Morris County beverage warehouse where a maintenance worker was electrocuted in 2017 cannot be held liable for the man’s death, an appellate court ruled Friday.rests with the company he worked for, High Grade Beverage, Inc., which leased the warehouse on Canfield Avenue in Randolph, and not the building owner, HGB Realty 2, the appellate court said.

Administrators of King’s estate sued the tenant, High Grade Beverage, and the building owner, HGB Realty 2. In a deposition that followed, the maintenance supervisor, Perry Morris, said some of the lines in the electrical box were not legibly marked — an assertion that was later backed up by an expert witness, according to the appellate decision.

The appellate court upheld the lower court decision that under terms of the 2016 lease, it was the responsibility of the tenant to keep the leased premises, including the electrical system, “in good condition and repair,” the ruling said.
