The next day he emailed Apollo’s legal counsel on the deal, “[D]on’t call JPM anymore as I know how this will work.” On March 5, Jhawar got another tip from Oberle, and then emailed his lawyer that he wanted to have a call immediately, even though it was Saturday night. Oberle, Jhawar wrote, “just called back with a preferred path.” Apollo’s original bid to acquire Fresh Market, made on January 25, was for $31.25 per share.
