A federal appeals court struck down a ban on bump stocks — a device that can be attached to a semiautomatic firearm enabling it to rapidly fire bullets.

ban was instated following a 2017 mass shooting in Las Vegas, where a gunman killed dozens of people and injured hundreds of others from his hotel room using weapons equipped with bump stocks.Those against the ban argued that bump stocks do not fall under the definition of illegal machine guns in federal law.

But the Bureau of Alcohol, Tobacco, Firearms and Explosives says they do, a position the Biden administration agrees on, per AP."A plain reading of the statutory language, paired with close consideration of the mechanics of a semi-automatic firearm, reveals that a bump stock is excluded from the technical definition of ‘machinegun’ set forth in the Gun Control Act and National Firearms Act," Judge Jennifer Walker Elrod wrote in the opinion.

The definition of "machine gun" does not apply to bump stocks, the opinion goes on to say. "And if there were any doubt as to this conclusion, we conclude that the statutory definition is ambiguous, at the very least."

I remember Trump supporters at the time saying he did this so it could eventually get thrown out in court. Obvious nonsense but luckily here we are.

This is very sad, especially for progress in America.

This was a political terrorist attack at best to get guns banned or a criminal nut job with a lot of money and ignorant hotel staff at worst,sadly we may never know since nothing has been released but the lack of info usually means they don't want you to know

NB: this was a judge in the *FIFTH CIRCUIT* (please nobody be surprised) Likewise, the majority opinion was written by a Federalist Society judge appointed by Dubya. (also no surprise) SCOTUS has bee rejecting bumpstock appeals, but one hopes they'll take this one.

And if the Vagas shooter had any knowledge he would know not to use this is a gimmick part,you can't really aim the firearm and you spend the whole time focusing on getting it to fire,that shooting could have been worse if he knew anything about firearms
