A man who accidentally dropped the keys to a company car, and strained his back picking them up, will receive workers compensation.

SA Power Networks said the injury was not connected with his employmentThe South Australian Employment Tribunal has ruled that Robert Thelan, a works coordinator for SA Power Networks, must be compensated for the injury.

Mr Thelan accidentally dropped the keys to the four-wheel-drive ute onto the driveway, according to the judgment of Deputy President Judge Miles Crawley. He was subsequently unable to work and incurred medical expenses, but SA Power Networks rejected his compensation claim.

Yes, I'm a physiotherapist and it does happen. Seen dozens of similar incidences over my career. Still remember the first - a fencer who had come in for the saturday dance and landed in hospital while pulling on his boots. All recovered with exact and immediate attention.

A strain only? A ridiculous con compared to the intent of the compensation system. Makes it nearly impossible for employers to safeguard people. Demonstrates the true folly between OHS law’s duty of care and compensation law’s no fault principle. Entrenched system needs rework!

Any lawyers want to weigh in? From my lay-POV they made a mistake in claiming it wasn't work-related injury. Perhaps if they'd argued it occurred due to his improper manual handling technique - leaning from the car instead of getting out and bending at the knees.

Come on ABC, the headline may as well be on one of the tabloid toilet papers! The man was called out to a job by his employer & it was a “work” car not some executive package remuneration vehicle!

Wait before you judge this. You can do damage over time and then one small move triggers the dramatic and painful damage. I expect HCP who know something about this weighed in on this. I know people lie but there is room here for more consideration about what actually happened.
