They are seeking monetary relief “in an amount significantly above $1,000,000.” They also “respectfully demand a trial by jury.” Without cause or justification, Defendant Hernandez crossed the double yellow lines on SH 21 and drove into oncoming, westbound traffic on SH 21. Defendant Hernandez struck Mr. Wallace’s vehicle at a high rate of speed, killing Mr. Wallace.The lawsuit states that Hernandez was a “highly dangerous driver who never should have been allowed to drive a concrete pump that day.” It says his negligence caused the crash.
