Become an InsiderPizza Hut mega-franchisee NPC International argued in a filing on Tuesday that it should be able to sell its 900 locations to anyone it wants — including rivals like Papa John's and Domino's.
NPC said in a filing in the US Bankruptcy Court for the Southern District of Texas on Tuesday that it plans to accept bids on its 900 Pizza Hut locations from any potential buyers. Further, NPC said, it would consider bids from buyers that may not want to operate the locations as Pizza Huts — including the pizza chain's competitors.
"Such a transaction would require no consultation with, or purported consent of, the franchisors and may be preferable for that reason alone," the filing reads. that NPC could close up to 300 locations prior to putting the remaining 900 up for sale. NPC is seeking at least $325 million for its remaining Pizza Hut locations, expressing a preference for a single buyer.
Pizza Hut argues in the filing it has the right to oppose the sale of the Pizza Hut locations as part of its franchise agreement with NPC. There will be a hearing on Wednesday afternoon in the US Bankruptcy Court for the Southern District of Texas regarding NPC's proposed bid procedures for the sale of its assets. Pizza Hut and NPC have been at odds for years.NPC's status as a Pizza Hut franchisee means that the company independently owns hundreds of Pizza Hut locations.
