Adelaide real estate agent Zane Pitt says he is 'very, very happy' after a court ruled that the pensioner he bought a house from for $175,000 did not have a 'special disadvantage' during the transaction. Mr Pitt's daughter subdivided and built two properties on the block, which went on to sell for a total of $765,000.

His daughter subdivided and sold the two new houses on the property for $765,000The South Australian Supreme Court's decision in favour of Zane Anthony Pitt relied on a High Court judgement from 2019It reinstated a Magistrates Court decision that dismissed the action initiated by South Australia's Commissioner for Consumer Affairs.He said he was "very, very pleased" with the judgement and that he had been "exonerated".

After acquiring the property, Mr Pitt transferred its ownership to his daughter, Tarnia Pitt who, according to a statement from Consumer and Business Services last year, subdivided it, built two new houses on it and sold them for a total of $765,000 in 2014 and 2015.

They said Mr Pitt was in a better bargaining position than Mr Hartwig, but the latter did not have a "special disadvantage" that affected his ability to protect his own interests. They agreed with the magistrate's decision to compare the case to the judgement on the "book-up" system at the Mintabie General Store.That High Court judgement found the system was not unconscionable since the owner's customers knew what they were entering into.
