A petroleum company and its two directors were charged in court for exceeding the allowed limit of diesel sales to a lorry.

A petroleum station company and two of its directors were charged at the Sessions Court here today on charges of allowing the sale of 6,562 liters of diesel to a lorry, exceeding the permitted limit, last year. The company, represented by its two directors Lim Kok Ban, 63, and Othman Mohamad Supian, 59, as the accused persons (OKS), however, pleaded not guilty when the charges were read to them before Judge Mohamad Kamil Nizam.

According to the charge, Lestari Kasturi Sdn Bhd together with both OKS as retail licensees allowed the sale of diesel to a lorry, a scheduled petroleum product, amounting to 6,562 liters at about 7 pm at a petrol station in Bandar Baru Nilai on August 21, 2023. Therefore, the company and the OKS involved failed to comply with the Malaysian Supply Control order, which allows petrol stations nationwide to sell diesel to vehicles with Malaysian registration numbers not more than 250 liters per transaction per day into the vehicle's original tank. The company committed the offense under Regulation 21(1) of the Supply Control Regulations 1974 and can be punished under Section 22(2) of the Supply Control Act (ACA) 1961, which provides for a maximum fine of RM2 million and for the second or subsequent offense, a fine not exceeding RM5 million, if found guilty. The two OKS were also charged under the same regulation and read together with Section 22(4) of the ACA 1961 and can be punished under Section 22(1) of the same Act, which provides for a maximum fine of RM1 million or imprisonment for a maximum of three years or both, if found guilty. Deputy Public Prosecutor Nor Alimah Mohd Sanusi applied to the court to offer bail of RM10,000 for each OKS with a citizen guarantor. However, counsel representing both OKS, Rosmira Embong, applied for bail of RM5,000 for each OKS on the grounds that both of them supported their families and they also had health problems that required treatment
