A security company and its four directors pleaded not guilty to seven counts of failing to pay service tax amounting to RM186,909.08 including penalties.

A security company and four directors were charged at the Sessions Court here today on seven counts of failing to pay service tax amounting to RM186,909.08 including penalties for 2021 to last year. Perisai Sepadu Security Sdn Bhd and four directors – Mohd Yusoff Yunus, 64, his daughter Mira Nabihah, 29, and Ahmad Afwan Mazlan, 27, – as the Respondents (OKS) however pleaded not guilty to the charges which were read separately before Judge Mohd Zul Zakiqudin Zulkifli.

Another director who is also Mohd Yusoff’s son, Marini Najihah, 24, was absent from the proceedings, and lawyer Azrul Alias who represented her informed that the woman was currently taking exams at a higher education institution. According to the charge, the OKS as the taxpayer under the Service Tax Act 2018 (Act 807) was charged with failing to pay tax to the Director-General of Customs for the taxable period between July 1, 2021 and February 29, 2024. The offense was alleged to have been committed at the Terengganu Customs Building, Jalan Balik Bukit here, with the charges against the OKS being brought under Section 26(8) of the same Act which provides for a fine of up to RM50,000 or imprisonment for a maximum of three years or both, if found guilty. In addition, the OKS was also required to pay a penalty of RM53,402.59 for not explaining all the taxes within the prescribed period, as provided for under Section 26(10) of the same Act. During the proceedings, Azrul who also represented other OKS pleaded bail of RM5,000 for each charge with a guarantor offered by the prosecution to the OKS, reduced due to the financial situation of his client. The court allowed each OKS to be bailed at RM1,000 with a guarantor for each charge and set February 17 this year for the mention of the case. The prosecution was conducted by Royal Malaysian Customs Department (JKDM) Prosecutors Nur Zahidah Razali and Mohd Izwan Ismail
