Isn't that how laws usually work?

I think in many cases these companies are insolvent and simply don't have the cash to provide refunds. I'm not sure that the threat of legal action will make much difference to that.

i remember the pictures clearly how uk tourists didnt followed the spain police officers during the outbreak. Well, the current situation does not surprise me
