But the trade group that brought the suit said Thursday they lost on a technicality. The National Shooting Sports Foundation pledged to revive the fight if New Jersey goes after any of their members in court.
On Thursday, a three-judge panel threw out the case, finding the gun groups lacked standing because the office hadn’t actually done anything yet. New Jersey’s new nuisance law requires the gun industry to “establish and implement reasonable procedures, safeguards, and business practices for the sale, manufacture, distribution, importing, and marketing of gun-related products”. Failing to do so could now open them up to lawsuits in state court.
