This is the first time that the department is requiring airlines to agree to a binding consumer protection order to close a merger. According to a release by the U.S. Dept. of Transportation , the Alaska and Hawaiian must protect the value of rewards, maintain critical inter-island and continental routes, preserve support for essential air service in Alaska and Hawaii, guarantee fee-free family seating, as well as provide alternative compensation for airline caused delays and cancellations -- among other stipulations.
USDOT says the commitment must “not impact the synergies of the deal, which will enhance competition and expand choice for consumers.
