A man in Maryland was shot and killed by a fellow business associate on December 13th, 2023, leaving authorities investigating a potential motive rooted in a financial disagreement.

Maryland investigators say Austin P. Potocki, 30, of Hanover, laid in wait the morning of Dec. 13, then repeatedly shot at Benjamin Billings’ pickup truck at Wesley Road and Patapsco Road in Finksburg, Carroll County. Billings, 33, was pronounced dead at the scene. The 42-year-old man in his passenger seat, who also was a business partner of Potocki, suffered non-life-threatening injuries.

Investigators combed the crime scene but were unable to find any shell casings from the murder weapon, which they believe was a .223-caliber rifle. The shooter is believed to have used a device to catch spent shell casings to avoid leaving evidence at the scene, according to the Carroll County Sheriff’s Office. Billings’ passenger told investigators from the sheriff’s office that he and Billings were headed to Wawa the morning they were ambushed, according to a search warrant filed in York County. As they stopped at a stop sign at the intersection, Billings’ passenger said he heard several loud pops and was hit in the left arm. He got out of the truck and ran around the back, then opened the driver’s side to put the vehicle in park since Billings was unresponsive behind the wheel, the search warrant said.Court documents said Billings’ passenger runs Legacy Pool & Spa, a pool installation business, and had been in business with Potocki, who owns Austin’s Pool Service and was a subcontractor for Legacy Pool. Billings’ familyhe was the owner of Monzter Earth Movers LLC, an excavation and landscaping company that’s affiliated with Legacy Pool. Within days of the shooting, the Legacy Pool owner told investigators he and Potocki had a business deal that involved Potocki paying him $50,000 over five years. However, Potocki had fallen behind on the payments, according to the search warrant.
