says the Labour Court can improve its performance in discharging its judicial functions. He delivered the 2022/23 Annual Judiciary Report at the Constitutional Court in Johannesburg.
The Court achieved a 58% performance metric, achieving its set target by finalising over 2000 matters out of a total of just over 3 500 matters. In the 2021/22 financial year, the specialist court finalised 60% of matters before it. During the period under review, 18% less Labour Court matters were enrolled compared to the previous period. The case load decreased in all centres, except for Durban which saw an increase of 7%.
“It set for itself a low target of 58% and achieved it, it needs more posts for judges in order to cope with the workload. Indeed, it’s been a few years that the Labour Court has approached the executive to ask for more posts for judges to be created, to ask for more courtrooms so that more cases can be done. I have been involved in that. That has not been coming as quickly as it should have. There is nothing judges can do if there are not enough judges and if there are not enough courtrooms.
