Contralesa welcomes recommendation to pardon AbaThembu king Contralesa has welcomed President Cyril Ramaphosa’s decision to receive Justice Minister Michael Masutha’s recommendation to pardon AbaThembu king Buyelekhaya Dalindyebo.

Dalindyebo is serving an effective 12-year prison term for three counts of arson, three counts of assault with intent to do grievous bodily harm, one count of defeating the ends of justice and one count of kidnapping.

The Congress of Traditional Leaders of South Africa has welcomed President Cyril Ramaphosa’s decision to receive Justice Minister Michael Masutha’s recommendation to pardonDalindyebo is serving an effective 12-year prison term for three counts of arson, three counts of assault with intent to do grievous bodily harm, one count of defeating the ends of justice and one count of kidnapping.

Contralesa secretary-general, Zolani Mkiva says, “The kings are not necessarily above the law but they cannot be treated like you and me because they are kings to their people. We are all equal before the law and we agree on that. But our constitution also recognises the institution of traditional leadership together with its own nuances.

Meanwhile, the Presidency has denied the DA’s allegation that President Cyril Ramaphosa’s consideration to pardon the AbaThembu king is an attempt to buy votes. Presidency spokesperson, Khusela Diko, says President Cyril Ramaphosa will not allow such distortion of information to pressure him on deciding on the parole application by Dalindyebo.had earlier furnished the President with documents, as per his request on whether or not Dalindyebo will be granted a Presidential pardon.

“We must hasten to add that this is not the only application that the President is dealing with – it’s very unfortunate that some of us, among us, would have wanted to use this as an electioneering tool, calling the President to make the decision because people won’t vote. That is not what’s going to drive the decision by the President, but rather what is in the public interest and whether indeed it fits in with the requirements of the law.

I will not be surprised if the President pardon’s the King and am so sure that he will pardon him,He doesn’t need any documents to decide whether or not he has to pardon the king , ANC will do anything for those votes.

He committed crime and must deal with the result, he must complete the sentence.

Three questions- 1. Did the Minister of Justice consult with the victims and if not, why not? 2. On what grounds will HM be pardoned? 3. With reference to equality in s9 of the Constitution, 1996 will the President pardon all other offenders that qualify on the same grounds?

King Dalindyebo must serve his sentence in full.He is not above the law.

Presidential pardons are for activist and people who broke the law doing good for others not criminals.

Many delinquent monarchs were executed when found guilty by their constitutions. Y is he being spared? The law must be held in higher regard than an Abathembu King. He must stay in Jail for the crimes he committed. He sure does qualify for an appeal but not a presidential pardon.

This is the problem,did the ANC find him guilty,did Zuma find him guilty,what are we trying to do or to say to our law system,is it working or it chooses people,kumele aqede isgwebo sakhe.ANC is not the law.he must stay in prison for his wrongdoing
