Tense testimony illuminates years-long grudge between Dauphin County borough, fire company

The controversy began in 2022 when Paxtang Borough Council voted to sever its formal ties to the Paxtang Fire Company and insteada rapidly regionalizing fire company, to provide fire protection for the 1,640-person borough nestled between Swatara Township and Harrisburg. Fillman, meanwhile, testified the borough did not want to evict the fire company at first. The eviction only came about when the fire company refused to add Paxtang Borough to its insurance agreement, which would eliminate the borough from being legally liable for the company.

Both parties moved toward compromise after Judge Andrew Dowling issued an order requiring them to adopt a Facilities Use Agreement, which set temporary rules for the fire company’s use of the building. That agreement did not include rent but did compel the fire company to list the borough as “additional insured” — meaning, the borough would not be liable for the fire company’s actions.

Bonn asked if the fire company could pay 50% of the borough building’s utilities for the space and rent proportionate to the number of square feet the fire company occupies — which comes out to a market value of around $1,700. That being said, Ford also said the fire department would not be willing to reimburse the borough for attorney fees and expenses the borough incurred since litigation began — something the borough is seeking from the jury.
