Attorney-General Christian Porter says social media platforms should be treated the same as traditional publishers under defamation law, a change which would present a fundamental new challenge for global companies like Facebook and Twitter

Mr Porter expressed the view in a speech on Wednesday, declaring the legal environment for traditional media companies was not fair and it was necessary to update defamation law as part of a national review being undertaken by federal and state governments.The Attorney-General said "defamation laws don't strike the perfect balance between public interest journalism and protecting individuals from reputational harm".

He highlighted the complex issue of the different legal burdens facing traditional media and digital platforms, including Facebook. He said the new players should be treated the same as the old."My own view ... is that online platforms, so far as reasonably possible, should be held to essentially the same standards as other publishers," he told an audience at the National Press Club.

"But you have to of course take into account, reasonable, sensible measures for how you do that ... because of the volume of what goes on in Twitter and Facebook is much larger than the volume from a standard newspaper."

This make so much sense, social media has grown out of control. No one is taking any responsibility for so much rubbish published online.

dwinnera Social media isn't a publishing house. It isn't any single thing. For some it's a highstreet. For others the village pub. There needs to be differentiation between those who use it professionally, those who use it for campaigning, and those who just use it for letting off steam.

Given they spent a few years criticising Labor and in particular the very personal attacks on Julia Gillard, allowing shock jocks to pursue it too, this smacks of the worst 🐴💩 A-grade hypocrisy they’ve come up with yet. Do they dare backdate this “defamation” crap?

Yes and no. if they act like a publisher and determine who, what can go on their business then treat him like a publisher but if they are just a platform for all with no ifs or buts then treat them like a platform

It’s interesting to see the naming+shaming of people, men mostly in alleged sexual assault matters b4 a fair days hearing in court that continually occurs on media social pages+bulletins. The insinuation in most stories of guilt, then no follow up or apology when found not guilty

Yet politicians can tell any lies under parliamentary privilege. Sounds like one rule for some.

Actually they should be treated like highways. They should be free of judgement as long as they refrain from any interference to passing traffic. They should have their advertising limited and be defended from corporate takeovers of space. Policing should be limited

Another nail in the coffin of free speech.
