The rare prosecution of coal company officials over safety violations is similar to a case brought against a former West Virginia coal executive in the wake of a 2010 coal mine explosion that killed 29 miners. Along with Hardison, former Parkway mine superintendent Charley Barber; the Parkway mine's former safety director Brian Keith Casebier and Dwight Fulkerson, a section foreman, are facing conspiracy charges at the trial. Each is charged with conspiracy to defraud the United States.
Three of the original nine men charged in the case have reached plea deals, and two more received pretrial diversion, meaning their charges can be dropped if they stay out of trouble.
Here's hoping they actually have to face anything other than a slap on the wrist, though at least putting them in front of a judge is a start.
