MTN misled customers in an ad by promising freebies – but failed to clarify that the offer was limited to 1,000 in-store customers, the Advertising Regulatory Board (ARB) ruled, in the second such finding against the company within months.

by promising freebies with a new cellphone contract – but failed to clarify that the offer was limited to 1,000 in-store customers, the Advertising Regulatory Board ruled, in the second such finding against the company within months.

In its defence, MTN argued that the advert with the freebies appeared on page 40 of the promotional booklet, with “T&Cs” below. The device in question appeared on page 41.Both pages were dedicated to Xioami contract deals, and the terms and the Ts and Cs appeared on page 40, and not on page 41, because the Xiaomi Redmi Note 11 appeared first on page 40.

While the ARB accepted that there are reasons why the customer did not receive the freebies, the advert still did not clearly show customers the deal's limitations.
