Brian Chavez. COLUMBUS, Ohio – The Ohio Oil and Gas Commission dismissed an appeal Friday in a case involving whether to hand the $1.3 million bill to clean up leaked hydraulic fracturing wastewater to a company owned by a Republican state senator and former commissioner.

State Sen. Brian Chavez, a Marietta Republican, owns Deeprock Disposal Solutions, which has two Noble County wells that store brine – the toxic, sometimes radioactive byproduct of fracking operations. Before his December appointment to the Ohio Senate, Chavez served on the Ohio Oil and Gas Commission for about 2.5 years and starting about five months after the leak was discovered.
