The MOU makes provision for grandparents to assist their maintenance defaulting child.

Legal analyst Mpumelelo Zikalala says the law makes provision for grandparents to step in and assist their maintenance defaulting child.

Justice Minister Thembi Simelane has signed a Memorandum of Understanding with the Consumer Profile Bureau and Social Justice Foundation to deal with child maintenance defaulters. The MOU will see the personal details of child maintenance defaulters given to Credit Bureaus and credit providersHe says, “If you are a parent, if you are responsible for bringing a child to this earth then you must make sure that you can maintain it. Now our law has developed into an instance in which it’s now extended to grandparents, even to say if you have the means to take care of your grandchildren, please step in because we want to protect this innocent soul.

“We want to make sure that it’s perfectly catered for and we can’t do that without the finances, so we will try all our means to say how can we make sure that we collect the money for maintenance so that the child is able to go to school and your basics to take care of the basic amenities,” adds Zikalala.
