Lawyers are fielding questions about what corporations and businesses can do to protect their women employees.

Dunn is advising his clients to seek advice from different types of professionals, including employee benefits lawyers, criminal lawyers and accountants. He said if a company is in a state where the law prohibits abortion, that company or its employees could be charged with aiding and abetting criminal acts or acting as an accessory by the state prohibiting abortion. The legal issue is whether the state prohibiting abortion can apply its law to acts out of state, he said.

“The cost of doing this is probably going to go up significantly for the company if it can’t be a tax-free benefit, and that could cut both ways,” Dunn said. “It could fall on the company and not be deductible or fall on the employee — to pay taxes on it.”
