It's relatively safe to invent conspiracy theories about dead people, such as murdered DNC staffer Seth Rich, since the dead cannot sue for defamation. Part of what makes the situation with Dominion and Smartmatic unusual — and as Smith notes, so terrifying for media companies that have aired the false allegations against them — is that the companies have unusually good reason to believe going to court will be worth the trouble. The statements made about them were outlandish and obviously false. They have a clear story about how the statements were damaging to their financial interests.
