In an exclusive, Nastassja Jansen tells Chriselda Lewis she would have never spent 29 days in jail - if police did their job properly. She details all she lost and is considering suing the state for wrongful arrest. This after charges of aiding and abetting Bester's escape were withdrawn against her and two other accused in the Bloemfontein Magistrate's Court.
Contrary to the fact that the charges against her were withdrawn in the Bloemfontein Magistrate Court before the matter was transferred to the Free State High Court.According to a letter written to Jansen by the prosecution, she was informed that she was a compellable witness and was to meet with the prosecution to give a statement.In a responding letter, Jansen advises the prosecution that she is not obligated to meet with them.
“The case of Natassia Jansen was withdrawn before the matter was taken to the High Court the charges were withdrawn. That gave an idea of permanence because clearly if the case has been withdrawn it means that Natassia Jansen was not gonna be part and parcel of what happens in High court in terms of the pretrial and ultimately the trial,” says Koenane.A legal analyst from the University of the Free State says under Section 204 a witness is compelled to provide self-incriminating evidence.
