When the GoFundMe crowdfunding platform warned the funds would be returned to donors if they weren't directed to a registered non-profit, Kolfage and his associates created a 5014 non-profit called "We Build the Wall, Inc." They urged donors to redirect their funds to the non-profit. And they promised the money would help fund parts of the border wall built on privately-owned land. for not complying with federal regulations and potentially being structurally unsound.

Instead, prosecutors say Kolfage secretly took $350,000 from the non-profit and Bannon took more than $1 million, which he used to secretly pay Kolfage and cover hundreds of thousands of dollars in his own personal expenses. The two other associates, Andrew Badolato and Timothy Shea, were also arrested and charged defrauding donors.
