Power to close factories — does it lie with the state or federal govt? — Hafiz Hassan

JULY 12 — The National Security Council has halted the operations of 63 factories, business premises and construction sites for violating Covid-19 regulations.

The Local Government Act 1976 empowers local authorities to license premises and industries, and the matter is clearly within the state government’s purview. Under Section 107, local authorities are empowered to revoke licenses issued by them at any time without assigning any reason. Even though the Federal Court did not refer to an illuminating observation of Chief Justice Raja Azlan Shah in an earlier Federal Court case of , subsequent courts have.“Every legal power must have legal limits, otherwise there is dictatorship. In particular, it is a stringent requirement that a discretion should be exercised for a proper purpose, and that it should not be exercised unreasonably.”

syahredzan Stop debating which govt has the power to shut down factories. Just close down those damn factories now!!

syahredzan Dia sendiri jemput orang sekolahkan dia. Bila disekolahkan jawab secara sinis dan sindir.

I don't anything about laws, but I see there's a loophole for the state gov to do something, however most of the power reside with the state gov. But, this is the writer's own opinion. Just hope the ppl in power do something that benefits the ppl!

Federal la of course, even if PBT goes on raiding to close them, those kilang'd just show the MITI approval letter they applied at state level and approved at federal level, which trumps state power because of darurat.

He said stern action... If workplaces had done a better job to fight this war, our hospitals wouldn't be stressed so badly. Yup. Heard that since March 2020.
