Kenyan court must decide if it has the right to hear Daniel Motaung’s case against Meta

A Kenyan court decides if it has jurisdiction to hear the case against Meta, brought by Daniel Motaung.

“It will lift the lid on content moderation, and just how badly the staff are treated that do that work.” In court proceedings and submissions, it has only said that as it’s incorporated in Delaware, in the US and in Dublin, Ireland, the Kenyan courts have no jurisdiction over it because they are “neither resident nor domiciled in or trading in Kenya.”For its part, Motaung’s legal representatives argue that Meta does operate in Kenya, via its Facebook, WhatsApp and Instagram platforms.

“Facebook pays digital service tax to the government of Kenya for the advertising revenue it draws from Kenya,” they say in court filings.
