The Texas Commission on Environmental Quality is facing a preliminary investigation by the U.S. Environmental Protection Agency that could eventually result in it falling under federal control.

The United States Environmental Protection Agency is conducting an informal investigation of the Texas Commission on Environmental Quality and its ability to carry out responsibilities required under federal regulations.

Such a change in administrative power would certainly impact many real estate developers working in environmentally sensitive areas in the state, who must seek various TCEQ approvals. Recent local examples include Silicon Valley-based Lexor Investments Inc.'s plans to build a 5,000-seat outdoor amphitheater venue in the Hill Country southwest of Austin and a vineyard-centered mini-resort near Driftwood from the owners of Terry Black's Barbecue.
