The Fair Work Commissioner described it as harsh, unreasonable and unjust and an example of how the conduct of employees outside of work hours is becoming the subject of scrutiny — but now the company involved is appealing.

In his judgement, commissioner Cambridge said the conduct of employees outside of work hours had increasingly become the subject of"potential scrutiny" by employers.

"The employer was understandably concerned that the misconduct of the applicant at the farewell drinks function might have some impact upon the renewal of its contract with its major client, the Sydney Opera House. "However, on any reasonable and objective contemplation, a single act of drunkenness at an after-work function which did not involve any abusive or aggressive behaviour, and for which no serious risk to the reputation or viability of the employer's business could be established, would not represent misconduct [for] dismissal."

"Getting yourself so drunk that you vomit, well it is common sense that this is not appropriate behaviour," he said."There is ground for disciplinary action, but dismissal is another question."
