Company executives, and technologists themselves, are agreeing that with artificial intelligence there is a need for regulation paid intel

But they realize they can’t do it alone. Because AI is evolving so rapidly and impacting people’s lives in a number of ways, and because of the potential for harm and untested legal risk, they want rules and oversight.

In sectors like financial services and healthcare, for instance, regulations already dictate how an action should be performed by a human operator , while other regulations prescribe how some technologies should operate. But the two don’t always overlap and the regulatory blind spots can be gaping. Today, machine learning and deep neural networks are among the shiniest tools offering many possibilities, including the ability to recognize patterns and images by parsing complex data sets. But we’ve already seen that deep-learning AI can carry the risk of discrimination and bias depending on the data it was trained on. Even some of the most advanced facial recognition software tools sometimes can’t detect people of different skin colors.

Although laws exist that bar discrimination based on gender, it can be difficult to police an AI agent discriminating in such subtle and barely detectable ways. Ultimately, the company had to pull the software, recognize AI’s limitations, and start retraining the algorithm. On the other hand, recent high-profile data breaches and the improper use of data in the political sphere have sparked demands for more protections and greater oversight. So federal agencies and lawmakers in the U.S. are seeking a delicate balance. They are creating advisory committees to study the issues and joining public-private partnerships, but not rushing to adopt regulations.

Not only must firms obtain informed consent from users, they must also give them the choice to opt for a human operator instead of AI. Currently, I sit on the IEEE Ethical Certification Program for AI and Canadian CIO Strategy Council advisory committees, which are working to develop basic standards for AI regulations. While these aren’t yet formal regulations, they’re a start.
