Hlophe was found guilty of misconduct by the JSC and impeached by Parliament last year.

Lobby group Freedom Under Law says its legal challenge against Hlophe is mainly based on matters of integrity.

But the MK Party, on the other hand, has labelled objections to Hlophe’s appointment to serve on the JSC as “racist”. In a previous statement, the party indicated that by designating Hlophe to the Commission, the National Assembly had acted within the ambit of the law and its constitutional mandate. Hlophe was found guilty of misconduct by the JSC which resulted in Parliament voting for his impeachment last year.Parliament’s spokesperson Moloto Mothapo confirmed that the Assembly was served with legal documents.
