Sinatro reportedly purchased a box of angel hair pasta from the Classic Barilla Blue Box Pasta line in 2021 for approximately $2.
Close-up of the logo on a box of Barilla brand pasta, captured in Lafayette, California, on Sept. 23, 2021. While Sinatro and Prost say they purchased only angel hair and spaghetti boxes from the Classic Barilla Blue Box Pasta line, the class action complaint is calling all 54 of Barilla’sinto question, including penne from the Barilla Whole Grain Pasta line; spaghetti from the Barilla Veggie Pasta line; penne from the Barilla Gluten Free Pasta line; and penne from the Barilla Collezione Artisanal Pasta line.
Barilla’s motion to dismiss the class action complaint includes questions on some of the product packaging images that were submitted into evidence. presents include statements that the plaintiffs don’t have a "plausible economic injury," the plaintiffs haven’t named a cheaper alternative they would’ve turned to and the complaint could pose a risk of future harm.
Barilla’s motion to dismiss noted that other brands make references to countries and national flags on product packaging as an acknowledgment of cultural roots. An example Barilla used to make its point included Ole Mexican Foods’ tortilla brand La Banderita featuring the slogan, "A Taste of Mexico," and a depiction of the Mexican national flag.
We need to stop all these frivolous lawsuits, and tighten our torte laws. We all wind up paying higher prices in the end. Look at the food on the fields that can go to food banks, but won't because of lawsuits
If they have time to sue the company, then they have time to make their own homemade fresh pasta!
It’s made in china!!! Fucking knew it.
You mean to tell me the 'manufacturered in America' means its not made in Italy... this is unacceptable
Nice, hope they get rich and buy houses to make an Airbnb.
What about all our products made in China
Lets sue Roundtable for not having round tables in their restaurant. Oh and throw Mountain Mikes in there too kuz Mike didnt even live around any mountains
Stupid. This law firm actively looks for brands it can sue.
Do these people not know how to read the back of a box?! I don’t know how much more clearly it can read Barilla America Inc - Made in the USA with USA and imported ingredients 🇺🇸🇮🇹 Northbrook, IL (Italy)
I'm suing jersey Mikes cuz my sandwich wasn't made in Jersey nor by a guy named Mike
These people are looking for an easy payout. This is a complete waste of everyone’s time.
Look at the box and it says where it was made. In the small print.
CORTNEY! 😆 'Pasta company Barilla might find itself in hot water....'
Zero context asked my wife where she thought Barilla pasta products were made. 'I don't know, Iowa?!'
What does the box say?
Anyone going to tell this person Philadelphia Cream Cheese is made in New York?
Hurry… lets try to get our $28 settlement from a pasta company cause we were snowed!!! … or just because we can!
They don’t even sell barilla in Italy
This lawsuit actually has wider consequences … what of Asian or European cars made in the US? Can they reference their original heritage?
Who gives a shit. It's pasta it's gonna make you fat
Has it anything to do with the fact that Italy has elected a right wing government?
Agree… companies shouldn’t label products from another country if made in a different one! Let’s be honest
Hey, can you give me a minute before I read this? I'm speaking with my lawyer about suing 'Irish Spring' becasue it's not made in Ireland lol Where is the legal oversight of these guys who obviously have made an industry of these frivilous lawsuits?
OMG who gives a $hit?
