The National Assembly has passed legislation which criminalises “revenge porn” or the distribution of private sexual photos and films without consent.is now scheduled to be sent to President Cyril Ramaphosa for assent. The changes have previously come under scrutiny over concerns that it would be used as a means of censorship for online content.
The bill aims to introduce a number of changes, which include harsher rules to protect children from disturbing and harmful content as well as the regulation of online distribution of films and games.Under the bill, any person who knowingly distributes private sexual photographs and films without prior consent and with the intention to cause the said individual harm will be guilty of an offence.
Punishment includes a possible fine not exceeding R150 000 and or imprisonment for not more than two years.
