A prominent securities law professor says that ad might run afoul of SEC rules against "conditioning" the market ahead of a stock offering—but for the fact that the ad itself doesn't say much. It has racked up nearly $300 million in total losses, and in its filling it says merely that it will become "structurally profitable" in the long term., but they grew just 11% in the six months ending Oct. 31.
