I don't believe that is how it works. The spot price is capped, but the general price has increased such that the overall revenue to the energy companies is the same or even more to cover their own increase in costs. As the number of companies is small, this covers the field.
Domestic reserve replicating Western Australia is the only way to prevent gouging.
