Employers have plenty of concerns in early 2023, with the state of the economy leading the way.

Broodo notes AI can have both human and systemic bias, which could put employers at odds with federal law. Thefor how the use of AI could violate the Americans with Disabilities Act. He also suggest they work with attorneys on indemnification clauses to protect themselves from unintended consequences of using AI in HR.

Connaughton said the key to these situations is to immediately have a one-on-one discussion with the employee to determine what’s actually being alleged.
