In its defence, MTN argued that the advert with the freebies appeared on page 40 of the promotional booklet, with “T&Cs” below. The device in question appeared on page 41.Both pages were dedicated to Xioami contract deals, and the terms and the Ts and Cs appeared on page 40, and not on page 41, because the Xiaomi Redmi Note 11 appeared first on page 40.
While the ARB accepted that there are reasons why the customer did not receive the freebies, the advert still did not clearly show customers the deal's limitations.
If you have to resort to deceiving customers, your products are not good enough and your leadership is unethical.
