Lobby group AfriForum says it will seek leave to appeal the decision of the High Court in Johannesburg to dismiss with costs its hate speech case against EFF leader Julius Malema, MP Mbuyiseni Ndlozi and the party.

This after people dressed in the EFF colours sang the song during the Brendin Horner murder case in the Free State last year.

AfriForum which brought the case argued that singing the song was tantamount to hate speech and inciting violence.The lobby group was seeking the imposition of sanctions on EFF members and for the party leaders to make a public apology. This is how Judge Edwin Molahlehi delivered judgment: “The complaint that the first impugned song “Kiss the Boer” or “Kill the Boer” or “Kiss the farmer” constitutes hate speech and unfair discrimination is dismissed. Two – the complaint that the second song sung “Bizani ifire brigade” or “Call the fire brigade” constitutes hate speech and unfair discrimination is dismissed. The complainant is to pay the costs … I hand the judgment.
