The ability to provide mental healthcare from afar will become increasingly crucial as behavioral health specialist shortages intensify

While the memo doesn't explicitly ask therapists to provide care in states they're not licensed in, Talkspace said it would "provide indemnification for any claim your insurance company denies due to state border issues or client state of origin…[and] fund any legal appearances before state regulatory boards.

The pandemic and newfound necessity of virtual care pushed governments to temporarily reconfigure regulations surrounding practice licenses—but it's unclear how long these changes will remain in place: When the coronavirus made its way to the US, the government cleared the way for more doctors to provide care across state lines.

We think we'll see calls from hospitals and telehealth entities for permanent legal change as telehealth remains an integral part of care delivery. MDLive CEO Charles Jones us in April that "the federal government urged states to allow doctors from other states to practice in their jurisdiction, but didn't take actions that would have superseded state law. So, [we were] dealing with 50 different states influenced by 50 different medical boards.
